Conditions Applicable to Promotional Giveaway:
• This promotional giveaway grants a full software license, including one year of maintenance and support to qualified entrants. Legitimate contact information must be provided for qualification. Licenses will not be delivered to anonymous or personal email accounts such as GMail, Yahoo or Hotmail accounts.
• By entering this promotion, entrant agrees to comply with these rules and agrees that SQL Farms, its subsidiaries and affiliates, will not be liable for any injury, loss or damage of any kind resulting from participation in this promotion or from the acceptance, use, misuse, or inability to use any product giveaway, except as may be stated in the product documentation.
• Any attempt to enter the promotion other than by the method described on this page is void. Any entries originating from any other method or source, including but not limited to automated or proxied web form submission, will be declared invalid and disqualified for this promotion. The use of any device, computer program or software to automate the entry process is prohibited.
• All customer information provided by customer for this promotion will be subject to the SQL Farms' privacy policy. SQL Farms agrees to handle such customer information in a manner consistent with these rules. Participants agree to such treatment of their information by entering this promotion.
• Submission of false, incorrect, misleading or fraudulent documentation may result in disqualification from this promotion and future SQL Farms promotions and may result in the submitter being subject to civil or criminal liability.
• All federal, state and local rules/regulations apply. Promotion void where taxed, regulated, restricted or prohibited by law and in Puerto Rico, the Virgin Islands and all U.S. territories and possessions.
• No cash or giveaway substitution, transfer or assignment by winner allowed. SQL Farms reserves the right to substitute an item of equal or greater value if the product giveaway becomes unavailable. Giveaways are not transferable. All applicable taxes and any other expenses not specified here are the sole responsibilities of the winner.
• If, in SQL Farms' sole opinion, any suspected tampering or technological corruption takes place, or if the promotion materials, or any portion thereof, are compromised by virus, bug or any other cause beyond SQL Farms' control which, in SQL Farms' sole opinion, corrupts or impairs the administration, security, integrity, or fairness of the promotion, SQL Farms reserves the right to terminate or suspend the promotion at any time. SQL Farms also reserves the right to provide product giveaways to eligible entries received prior to termination or suspension of the promotion.
• SQL Farms is not responsible for lost, interrupted or unavailable network, server, data, or other connections, miscommunications, failed or delayed telephone, fax, cable or other media transmissions, computer hardware, software or other technical failures, garbled or jumbled transmissions, Internet/network/ISP/or website access/availability, or other errors of any kind whatsoever, whether human or technical in nature, or any failure to receive entries due to any of the same or any related malfunctioning or event.
• In the event of a dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, education, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

• The use of SQL Farms' Software downloaded as a promotional giveaway is subject to the TRIAL EVALUATION SOFTWARE LICENSE TERMS AND CONDITIONS specified in the shrinkwrapped software license agreement. By downloding, installing, and using SQL Farms software obtained as a promotional giveaway you agree to SQL Farms' TRIAL EVALUATION SOFTWARE LICENSE TERMS AND CONDITIONS.
• CHOICE OF LAW AND VENUE/LIABILITY LIMITATION: By its entry, participant agrees that any and all disputes, claims, and causes of action arising out of or connected with this giveaway shall be governed by, and construed in accordance with, the laws of the State of Virginia, without giving effect to any choice of law or conflict of law rules; and shall be resolved exclusively by the United States District Court for the District of Virginia (Eastern Division) or the appropriate Virginia State Court located in Fairfax County, Virginia. Any judgment or award amount shall be limited to participant's actual out-of-pocket expenses incurred, including costs, if any, associated with entering this giveaway promotion, but not attorneys' fees. Sponsor shall not be liable for punitive, indirect, incidental or consequential damages. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. SPONSOR SHALL NOT BE RESPONSIBLE FOR FAILURE TO DELIVER ANY OR ALL GIVEAWAYS DUE TO EVENTS BEYOND ITS CONTROL.
